These Terms of Service ("Terms") govern your access to and use of the services provided by Confused Apes LLC ("Confused Apes," "we," "us," or "our"). By using our services, you agree to be bound by these Terms.

Eligibility

Our services are designed for business use. By accessing or using Confused Apes services, you represent and warrant that:

  • You are using the services on behalf of a business or commercial entity
  • You have the authority to bind that entity to these Terms
  • You are at least 18 years of age

Acceptable Use

You agree to use Confused Apes services only for lawful, legitimate business purposes. You may not:

  • Use our platform to send unsolicited bulk messages (spam)
  • Use any service to harass, threaten, or abuse any individual
  • Violate any applicable local, state, federal, or international law or regulation
  • Attempt to gain unauthorized access to our systems, networks, or data
  • Misrepresent your identity or affiliation with any person or entity

Platform Role and Liability

Confused Apes operates as a platform and intermediary that designs, builds, and manages automation workflows on behalf of client businesses. We are not liable for the misuse of SMS workflows, messaging tools, or automation systems by client businesses or their end users.

Clients are solely responsible for ensuring that their use of our platform and any automated communications comply with all applicable laws and regulations.

TCPA Compliance

If you use Confused Apes services to send SMS or other telecommunications, you acknowledge and agree that:

Compliance with the Telephone Consumer Protection Act (TCPA) and all related regulations is the sole responsibility of the client business.

This includes, but is not limited to, obtaining proper consent before sending messages, honoring opt-out requests, and maintaining records of consent. Confused Apes provides tools and guidance to support compliance, but ultimate responsibility rests with the client.

Termination

We reserve the right to suspend or terminate your access to our services at any time, with or without notice, for conduct that we believe:

  • Violates these Terms or any applicable law
  • Is harmful to other users, third parties, or the business interests of Confused Apes
  • Involves fraudulent, abusive, or unauthorized activity

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Pennsylvania.
